Pune Porsche crash: The teenager’s attorney discussed the teen’s adult trial

The lawyer for the 17-year-old juvenile who ran down and killed two techies said that the legal process could take nearly ninety days, following the Pune police’s three-day application to a higher court seeking permission to try the boy as an adult.

Lawyer Prashant Patil states that there are procedures under the Juvenile Justice Act (JJA) to ascertain whether the accused Child in Conflict with Law (CCL) is treated as an adult or a minor.

“This procedure takes almost ninety days to complete.Investigative agencies must file a charge sheet within 30 days of the arrest for a juvenile or CCL in order to treat them as adults. Following the filing of the charge sheet, a two-month process that involves social and psychological evaluations as well as a de-addiction test is implemented, according to the attorney.

He added that the accused does not have to continue receiving rehabilitation services throughout the process.

“The Honourable Juvenile Justice Board, on the operative orders, has directed to keep the Child in Conflict with Law in a rehabilitation home for 14 days, until June 5, in response to the applications from investigation agencies to modify the bail issued. We have rejected the application on the grounds of academic and legal objections,” he stated.

Patil made his statement on Wednesday, the same day that the Juvenile Justice Board revoked the teenager’s bail and placed him in a remand home.

The 17-year-old boy was driving a Porsche when he collided with a motorbike on Sunday morning in Pune’s Kalyani Nagar area, killing two techies, Anis Awadhiya and Ashwini Costa. The police claimed that the young child was operating the Porsche at 160 kmph at the time of the collision based on the CCTV footage.

The teenager celebrated his Class 12 results on Saturday night by throwing a party for his friends, as reported to the police. The group spent the evenings driving around and drinking at various restaurants in the city.

According to pertinent provisions of the Juvenile Justice Act (JJA) and the Motor Vehicles Act (MVA), the Pune police have detained the teen’s builder father for “failing to do his duty as a guardian.” The police claim that the father of the teenager instructed his driver to give his son the keys to the newly acquired Porsche Taycan whenever the adolescent made a request. The father’s attorney refuted the accusation, claiming that the driver had received the car rather than his son.

In addition, two pub owners were detained by the police for giving alcohol to underage customers.
