The Centre wants the Constitution Bench to define the powers of the Delhi Government.

The Constitution Bench of the Supreme Court is hearing a batch of petitions challenging the Delhi High Court’s order that the Lieutenant Governor is the administrative head of the National Capital Territory of Delhi. The petitioners, including the Aam Aadmi Party government in Delhi, have challenged the High Court’s order on the ground that it violates the Constitution’s scheme of things.

The petitioners have also challenged the view that the Delhi government is a “state” within the meaning of the Constitution. They have contended that the National Capital Territory of Delhi is a Union Territory and the Delhi government is only an extension of the central government.

The petitioners have urged the Constitution Bench to define the powers of the Delhi government and the Lieutenant Governor in order to end the “uncertainty” and “confrontation” that has arisen due to the conflicting orders of the High Court and the Delhi government.

The Constitution Bench, comprising Chief Justice Dipak Misra and Justices A.K. Sikri, A.M. Khanwilkar, D.Y. Chandrachud and Ashok Bhushan, is likely to pronounce its verdict on the batch of petitions challenging the Delhi High Court
